Legislative Recap: Tennessee Leads Nation in Ending Discriminatory DEI Policies

For too long, Diversity, Equity, and Inclusion (DEI) policies have discriminated against qualified individuals based on immutable characteristics like race, gender, and sexual preference. These policies prioritize group identity over individual merit, creating a system where decisions are not based on ability.

That ends now in Tennessee. I'm proud to report that we became the first state in the nation to successfully pass legislation prohibiting DEI hiring practices in local government and public universities. This historic achievement puts Tennessee at the forefront of the fight for true equality.

Understanding the DEI Problem: DEI initiatives may sound promising on paper, but in practice, they can perpetuate discrimination. Under these policies, decisions that should be based on merit, like college admissions, scholarships, and job applications, became based on someone's membership in certain minority groups. This discriminates against those who don't belong to preferred categories, regardless of their qualifications or character.

The U.S. Supreme Court recognized this injustice in 2023 when it struck down affirmative action in college admissions, ruling that race-based preferences violate the Equal Protection Clause. Tennessee Republicans took that decision and ran with it, ensuring our state leads by example.


Our Four-Pronged Approach to Ending DEI:

  1. Ended Race-Based College Admissions (HB377) - Public and private colleges in Tennessee are now prohibited from making admissions, scholarship, or financial aid decisions based on race, color, ethnicity, or national origin. This ensures equal opportunity for all students, with decisions based solely on individual merit. Students denied opportunities due to their race now have legal recourse.

  2. Eliminated Race-Based State Board Appointments (HB1237) - We eliminated discriminatory requirements for state regulatory and health-related boards. Appointments must now be based on qualifications and merit, not race or ethnicity. The bill includes a private cause of action, allowing individuals to take legal action if boards violate the new law. No one should be excluded from public service because of immutable characteristics.

  3. Banned DEI Hiring Practices (HB622) - Local governments and public universities are now prohibited from making hiring decisions based on race, religion, sex, national origin, age, or disability status. This includes county, municipal, and metropolitan entities. Tennessee is the first state to successfully pass such comprehensive legislation.

  4. Shut Down DEI Departments (HB923) - State and local governments, as well as public higher education institutions, are prohibited from maintaining offices or departments that promote or require discriminatory preferences to advance Diversity, Equity, and Inclusion (DEI). We join states like Texas and Utah in shuttering these divisive departments.


Why This Matters: These aren't just policy changes - they represent a fundamental shift toward true equality. We believe all opportunities should be based on merit, qualifications, hard work, and character. Period. When we judge people by the content of their character rather than the color of their skin, everyone benefits.


Real Impact:

  • Students applying to Tennessee colleges know they'll be judged on their achievements, not their ancestry.

  • Job applicants can trust they'll be evaluated on their qualifications, not their group identity.

  • Board appointments go to the most qualified candidates, ensuring better governance.

  • Taxpayer dollars aren't wasted on divisive DEI departments.


Looking Forward: Republicans will continue working to root out DEI policies in every corner of government, education, and healthcare. We're committed to ensuring that Tennessee remains a place where merit, fairness, and individual achievement—not identity politics—guide public policy.


This is what real equality looks like. This is what the American Dream demands. And this is what Tennessee delivers.
